Terms of Service

1. These terms

These terms govern your use of funneltrace.com and the FunnelTrace service, provided by the operator named above (“we”, “us”). By using the website or the service you agree to them. If you use the service for a business, you confirm you may bind it to these terms.

2. The service

FunnelTrace is a funnel builder and admin CMS for coaches: pages and funnels, lead capture and a CRM, payments, first-party tracking and attribution with consent, and integrations, with one workspace per brand. The service is in a pilot, by invitation only; during the pilot, features may change, be added or be removed.

3. Your account and workspaces

Keep your sign-in details safe and tell us at once if you think someone else has used them. You are responsible for what happens in your workspaces, including what the members you invite do.

4. Your content and your leads' data

You keep all rights in the content you add to the service. You are responsible for it, and for collecting your visitors' and leads' personal data lawfully: the notices you show them, the consent you obtain and the requests you answer. For that data you are the Data Fiduciary under India's Digital Personal Data Protection Act, 2023, and we process it on your behalf, as our Privacy Policy describes.

5. Acceptable use

Do not use the service to break the law; to send spam; to publish content that is misleading, infringing or harmful; to distribute malware; to impersonate anyone; to try to get around the service's security or limits; or to resell it without our written permission.

6. Payments you take

If you take payments through Razorpay checkout, Razorpay's terms and your agreement with Razorpay apply to them. If you point buyers to your own UPI, bank transfer or payment link, those payment methods are yours. We are not a party to payments between you and your buyers, and your own refund and delivery terms apply to what you sell.

7. Fees

The service is paid. During the pilot, pricing is agreed with each coach in writing before any payment, in INR, plus applicable taxes such as GST. Our Refund & Cancellation Policy applies to every payment made to FunnelTrace.

8. Third-party services

Integrations you switch on, such as n8n, Meta, and WhatsApp or email providers, are governed by those providers' terms. We are not responsible for services we do not operate.

9. Availability

We work to keep the service available, but we do not promise that it will be uninterrupted or without errors. During the pilot the service is provided as it is.

10. Our rights in the service

The service and its software belong to us. While you are allowed to use the service, we give you a non-exclusive, non-transferable right to do so under these terms.

11. Suspension and ending

You can stop using the service at any time. We may suspend or end your access if you break these terms or if we must do so to protect the service or others. You can ask us for a copy of your content before your access ends.

12. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profits, revenue or data. Our total liability to you is limited to the amount you paid us for the service in the 12 months before the claim arose.

13. Indemnity

You agree to compensate us for claims made against us by others that arise from your content or from your breach of these terms.

14. Law and disputes

These terms are governed by the laws of India, and the courts at Deoghar, Jharkhand have jurisdiction over any dispute arising from them.

15. Changes

We may update these terms. The date at the top shows when they last changed; if a change matters to customers, we will tell them by email before it applies.
